Terms of Use

These Terms of Use govern your access to and use of the language-learning service “Pidgeon” (the “Service”) provided by Takefumi Tomeda. By using the Service, you agree to these Terms.

Article 1 — Scope

These Terms apply to all use of the Service. Any guidelines, policies, or notices posted within the Service form part of these Terms. In case of conflict, these Terms take precedence unless otherwise specified.

Article 2 — Eligibility & Regions

The Service is available to users in Japan, South Korea, Taiwan, ASEAN countries, the Middle East, EU member states, Finland, Russia, African countries, the United States, Canada, Latin America, and other regions as we designate. You must comply with all applicable laws in your jurisdiction, including data protection and minor protection laws.

Article 3 — Age Requirements

The Service is available only to users aged 13 or older. Higher minimum ages apply in certain jurisdictions:

Users aged 13–17 must obtain parental or guardian consent before using the Service. By allowing a minor to use the Service, a parent or guardian is deemed to have accepted these Terms. You must provide an accurate date of birth when registering.

Article 4 — Contract Formation

The service agreement is formed when you agree to these Terms, complete account registration through our designated process, and we accept your registration. Actual use of the Service also constitutes agreement to these Terms.

Article 5 — Account Registration

You may register using a Google account or an Apple account. When using third-party sign-in, those providers’ terms and privacy policies also apply. You are responsible for keeping your login credentials secure and must not share, transfer, or sell your account. Each person may hold only one account.

Article 6 — Privacy

The handling of your personal information is governed by our Privacy Policy, which you should review before using the Service.

Article 7 — Service Description

We provide a platform where users can practice language learning through voice calls and text messaging with other users. The Service stores and displays study language, usage time, and learning history. The Service does not guarantee specific learning outcomes such as passing examinations or obtaining certifications.

Article 8 — Prohibited Conduct

You must not:

• Violate any applicable law or public order
• Engage in or facilitate criminal activity
• Harass, threaten, stalk, or bully other users
• Send sexual content, solicit sexual relationships, or engage in sexual exploitation or abuse
• Send or receive child sexual abuse material or similar content
• Discriminate based on race, nationality, gender, sexual orientation, religion, disability, or similar attributes
• Glorify or promote violence, self-harm, drug abuse, or similar harmful behaviors
• Send spam, unsolicited advertising, or MLM solicitations
• Conduct unauthorized commercial activity through the Service
• Impersonate us or any other person, or provide false profile information
• Use another user’s account or allow a third party to use your account
• Overload servers, probe for vulnerabilities, or reverse-engineer the Service
• Use bots, scrapers, or other automated means to access the Service
• Upload viruses, malware, or other harmful programs
• Infringe intellectual property, privacy, or other rights of us or third parties
• Use the Service for dating or romantic solicitation purposes
• Violate minor protection laws in any jurisdiction
• Any other conduct we determine to be inappropriate

Article 9 — Communications & Liability

We provide communication channels; we do not continuously monitor content exchanged between users. You are responsible for your own communications. Except in cases of our own willful misconduct or gross negligence, we are not liable for damages arising from user-to-user communications.

Article 10 — Minors & Age Misrepresentation

If a minor uses the Service without required parental consent, both the minor and their parent/guardian bear joint liability for resulting damages. If you misrepresent your age or other information to use the Service, we are not liable (except for our own willful misconduct or gross negligence) for any resulting harm to you or third parties.

Article 11 — User Content

You retain ownership of content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable license to use it for operating, displaying, improving, and securing the Service and for legal compliance purposes. We may remove content that violates these Terms without prior notice. You must obtain permission before re-using other users’ content.

Article 12 — Service Changes, Interruptions & Termination

We may change, suspend, or terminate all or part of the Service without prior notice in cases of emergency maintenance, force majeure, or legal requirements. Except for our willful misconduct or gross negligence, we are not liable for resulting damages. When permanently terminating the Service, we will provide reasonable advance notice.

Article 13 — Account Suspension & Deletion

We may suspend or delete your account, without prior notice, if we reasonably determine you have violated or are likely to violate these Terms. You may delete your account at any time through our designated process. After deletion, we may retain certain information as required by law.

Article 14 — Intellectual Property

All intellectual property rights in the Service’s programs, designs, logos, names, text, images, and other content (excluding user content) belong to us or our licensors. You may not reproduce, republish, modify, publicly transmit, distribute, or sell such content without our prior written consent.

Article 15 — Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.” We make no warranty, express or implied, regarding fitness for a particular purpose, merchantability, non-infringement, continuity, or freedom from errors. We do not guarantee that the Service will meet your expectations or be uninterrupted, timely, secure, or error-free.

Article 16 — Limitation of Liability

Except in cases of our willful misconduct or gross negligence, we are not liable for any indirect, incidental, special, consequential, or punitive damages. Where we are liable, our total liability is capped at the total fees you paid to us in the 12 months preceding the damage (or JPY 10,000 if the Service was free), unless applicable law prohibits such limitation.

Article 17 — Changes to These Terms

We may update these Terms when necessary. Changes will be announced in the Service or by other appropriate means, along with the effective date. Continued use of the Service after a change constitutes acceptance of the updated Terms.

Article 18 — Governing Law & Jurisdiction

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the court having jurisdiction over our place of business as the court of first instance.

Article 19 — Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

Article 20 — No Waiver

Our failure to exercise any right under these Terms does not constitute a waiver of that right.

Article 21 — Paid Features

The Service may include paid features such as ad removal, priority matching, and avatar items. Specific content, pricing, and conditions will be displayed in the Service or on designated pages.

Article 22 — Payment

Payments are processed through the App Store, Google Play, or other designated payment methods. We are not responsible for disputes with payment processors, except in cases of our own willful misconduct or gross negligence.

Article 23 — Subscription Auto-Renewal & Cancellation

Subscriptions automatically renew at the end of each period unless cancelled. To cancel, follow the process in the App Store or Google Play at least 24 hours before the renewal date. After cancellation, you retain access until the end of the current period. No pro-rated refunds are issued except where required by law.

Article 24 — One-Time Purchases

Conditions, validity periods, and expiry terms for one-time purchases will be stated in the Service or on designated pages. Tickets or points that expire do so as specified; we have no obligation to refund or compensate for expired items.

Article 25 — Refund Policy

Refunds are not provided for user-initiated cancellations, given the nature of digital services, unless consumer withdrawal rights apply under applicable law. If we make a billing error, we will refund or compensate through an appropriate alternative (e.g., extended access or points).

Article 26 — Regional Consumer Protection

Users in the EEA and other regions with specific consumer protection rules (e.g., withdrawal rights) may have additional rights under applicable law. We comply with applicable app store guidelines and consumer protection laws regarding paid feature disclosures and refund handling.
